1. Introduction and Agreement to Terms

Welcome to Bids App. These Terms and Conditions (“Terms”) are a binding legal agreement between you, the user, and the owner of the App, Mr. Nayani Rajendra Kumar, operating under the brand name ‘Bids App’ (“we,” “us,” or “our”).

These Terms govern your use of the Bids App mobile application (the “App”) and any related services. By downloading, accessing, or using our App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree, you must not use the App.

2. IMPORTANT: Disclaimer and Description of Service

A. Non-Affiliation with Government Entities: Bids App is an independent, private platform. It is NOT affiliated with, endorsed by, authorized, or sponsored by any local, state, federal, or international government entity.

B. Description of Service: Our service is the provision of a software platform that aggregates and organizes publicly available tender information from various official government portals and newspaper publications. We provide a tool for convenience, discovery, and notification.

C. Subscription Fees: Your subscription fee pays for the maintenance, development, and use of our aggregation platform and the service of organizing this public data. You are not paying for the tender information itself, which is available for free from its original public sources.

3. User Data and Privacy

Your privacy is important to us. Our Privacy Policy explains what information we collect from you and how we use and protect it. By using the App, you acknowledge and agree to the terms of our Privacy Policy.

4. Intellectual Property Rights

All content and materials in the App, including text, graphics, logos, and software, are the property of Bids App or its licensors and are protected by intellectual property laws. You may not reproduce, distribute, or modify any content without our prior written consent.

5. Subscriptions and Payments

Subscription-based services are processed through the Google Play billing system.

• Billing: Your subscription will automatically renew at the end of each billing cycle unless canceled. You will be charged in advance.

• Cancellation: You can cancel your subscription at any time via your Google Play account settings. The cancellation will take effect at the end of the current billing period. No refunds will be provided for the current subscription period.

6. User Conduct

You agree not to use the App for any unlawful purpose. You are prohibited from violating laws, infringing on intellectual property rights, transmitting malicious code, or attempting to gain unauthorized access to our systems.

7. Disclaimer of Warranties and Information Accuracy

The App is provided on an “as is” and “as available” basis. Your use of the App is at your own risk. Specifically, Bids App makes no warranty, express or implied, regarding:

• The accuracy, completeness, or timeliness of any tender information displayed.

• The App capturing and displaying every tender that has been publicly issued.

• The uninterrupted or error-free operation of the service.

8. Limitation of Liability

To the fullest extent permitted by law, Bids App and its owner shall not be liable for any indirect, incidental, or consequential damages, or any loss of profits, data, or goodwill resulting from:

• Your use of, or inability to use, the App.

• Business decisions, financial losses, or missed opportunities made based on information presented in the App.

• Any errors, omissions, or inaccuracies in the tender data provided.

• The App’s failure to display any specific public tender for any reason.

9. Indemnification

You agree to indemnify and hold harmless Bids App and its owner from any claims, liabilities, or expenses arising from your use of the App or your violation of these Terms.

10. Dispute Resolution

Any dispute arising from these Terms shall be referred to and finally resolved by arbitration in India in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Ananthapuramu, India. The language of the arbitration shall be English.

11. Account Deletion

You may request to delete your account at any time through the App’s settings or by contacting us. Upon request, we will delete your personal data in accordance with our Privacy Policy and applicable laws.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of changes by posting the new Terms within the App. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
